DON'T talk to police- VID

Post by Bravo »

How many of you guys have watched this yet?

A law school professor and a cop (who is also a law school graduate) both tell you why and give examples of how talking to the cops can be used against you.

I did a few years ago and it totally changed my perspective

HIGHLY recommend all of you do-

Respectfully,

I got pulled over for speeding

Highway Patrol motorcycle officer (DPS out here) asks me

do you know why I pulled you over?

me- no I don't officer

him- you were driving pretty fast weren't you?

me- I thought I was going with the flow of traffic and the speed limit

him- you really going to pull that shit with me and say you weren't speeding???

me- I thought I wasn't but you pulled me over for it....

later- him- well since I didn't have my radar running I am letting you off with a warning

=

if I HAD said I was speeding then me admitting it would have been all he needed to cite me

:D

technically if an officer doesnt serve you, no proof you got it

so if you change your Lic. address to a POBox- no way they can track you to serve you IF they ever do

people get in trouble when they admit to ignoring them

but if you just pitch it, like a jury summons, no way they know you got it unless you tell them.....

Think I'm pretty much screwed!

$240.00

I had this too:( Went to traffic court and pled guilty with an excuse. Judge knocked $90 off the ticket.
Some people in front of me talked to the Crown and she offered them a deal of $100 in court costs to plead guilty or with an excuse. And that was it. If the traffic cop writes the ticket wrong or doesn't' show up the case is thrown out too. So check the paperwork.

Hey guys, what's going on in here... Oh, heh, well, uh, I, uh ok, bye.

And don't talk to the police. The fifth and sixth amendments give us the right not to self incriminate and to retain counsel.
Also, Miranda only applies to custody. meaning that only when you are not free to leave is Miranda applicable.

Oh, and traffic cams are violations that are not witnessed by an Officer, so they are Civil, rather than Criminal.

Made me think of the two times I've had to deal with cops this year.

The first time I took a left when in the middle of the intersection as the light was turning red. I got pulled over and the cop came up and asked if I knew why I was getting pulled over.

Told him no. He said it was because I ran a red light at the intersection. I said I thought I was in the middle of the intersection and was trying to clear it. He was ok with that and let me go.

Second time was because I got in a car wreck. Basically me and this girl hit as we were both moving into the middle of a three lane road. BUT... I told the cop I hadn't been completely in the far right lane before I started to move back into the middle lane. So I got cited for improper lane change and had to go to court. Major pain in the ass. Sucks because I was the one who called the cops too.

Lesson learned.

We just lost our right to silence in New South Wales

If you want you can say nothing, but then can't use anything that you could have brought up in an interview later in trial...

Apparently this is so they can crack down on 'gun crime" and "bikies"

so instead of going back to where they should, i.e making less/removing laws to control people, this so called conservative government decides to take away more of our rights...
