Thought I'd share this. If you go to college and bang a drunk chick, it could end your academic career pretty fast. I don't think case law happens so much in college so no help as to how it would be interpreted. They just read whatever rule is in front of them and do there best guess as to what it means. Pay attention, it does sound like even if she is fully aware and wanting, you still could be in trouble.

been like that for a long time in multiple places
one cop buddy was even telling me how back in his town, if you have sex with your wife, after you both have been drinking, it is statutory rape.
read about a case where the guy choked a girl out while they were having sex, because he did stuff for the few seconds she was OUT, it was also rape
so always need to know the local laws to cover your 6, for all things

I wonder if a man could be prosecuted, even if its NOT the wife who makes an allegation on this?
Also, why is it not statutory rape of the man? under the same circumstance

I never understood the logic of this. If you choose to drink anything you do while drunk is till your responsibility. If a girl gets drunk and hooks up with someone then later regrets it she should not be able toruin a guys life.
What's next, women being immune from DUIs because "they were too drunk to make the decision to drive"?

All of this falls under consent laws. Like Bravo said, it's pretty much that way every where. If someone is intoxicated they cannot legally consent to sex (Kinda like being under age. No matter how bad she wants it, she can't legally consent).
